1. Who provides this service

Stimz Connect is provided by Flexi Fidgets Co. Ltd, a company registered in England and Wales (Company No. 15982398, VAT No. GB 494303485). Our registered office is 43 Dollywaggon Way, Bamber Bridge, Preston PR5 6EW, United Kingdom. In these terms, "we", "us", and "Stimz Connect" refer to Flexi Fidgets Co. Ltd trading as Stimz Connect.

2. Acceptance of terms

By creating an account or using the Stimz Connect service (including the iOS app and any associated website), you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, you should not use the service. These terms apply to all users of the platform, including carers, family members, and any person who accesses a profile by scanning an NFC tag or QR code.

3. Description of service

Stimz Connect provides an NFC-powered platform that allows carers to create digital profiles for neurodivergent individuals. These profiles can be accessed by members of the public via NFC tags or QR codes. The service may include scan alerts, location sharing, communication grids, and emergency contact notifications. Stimz Connect is a communication and information tool, it is not a medical device, tracking service, or substitute for professional care or emergency services.

4. Eligibility and accounts

You must be at least 18 years old to create a Stimz Connect account. Profiles may be created for individuals of any age by their parent, legal guardian, or authorised carer. You are responsible for maintaining the confidentiality of your account access and for all activity that occurs under your account. You must provide accurate and complete information when creating profiles.

5. Carer responsibilities

As a carer using Stimz Connect, you are responsible for ensuring that the information in each profile is accurate and up to date, that you have authority to share the information you include (particularly medical data), that you have consent from or authority over the person whose profile you are creating, and that the emergency contacts you add have agreed to receive scan alert notifications.

6. Use of the service by helpers

When a member of the public ("helper") scans a Stimz Connect NFC tag or QR code, they are granted temporary access to a profile. By scanning, the helper acknowledges that the profile information is shared in good faith for assistance purposes, the session is time-limited and will expire automatically, they should not screenshot, copy, or redistribute the profile information, and sharing their location is voluntary and will be sent to the profile's emergency contacts.

7. Medical information disclaimer

Stimz Connect may display medical conditions, diagnoses, and medication information as provided by the carer. This information is for awareness and assistance purposes only. It does not constitute medical advice. Helpers should always call emergency services (999 / 112) if someone appears to be in immediate medical danger. Stimz Connect does not verify the accuracy of medical information entered by carers.

8. Notifications and alerts

Stimz Connect sends scan alert notifications to emergency contacts via SMS, email, WhatsApp, and push notifications. While we make reasonable efforts to deliver alerts promptly, we cannot guarantee delivery times or that all messages will be received. Network issues, incorrect contact details, or third-party service outages may affect delivery. Stimz Connect should not be relied upon as the sole method of emergency communication.

9. Location sharing

When a helper shares their location after scanning a tag, this information is transmitted to the profile's emergency contacts. Location accuracy depends on the helper's device and GPS signal. Stimz Connect does not guarantee the accuracy of location data. Location sharing is always voluntary and the helper can decline when prompted by their browser.

10. Subscriptions and payments

Stimz Connect offers an optional auto-renewing subscription called Connect Alerts:

  • Product: Connect Alerts, monthly subscription.
  • Price: £4.99 per month (pricing in other currencies is set by Apple and shown to you in the App Store before purchase).
  • Billing: on iOS, subscriptions are billed by Apple through your Apple ID. Payment will be charged to your Apple ID at confirmation of purchase.
  • Auto-renewal: your subscription renews automatically each month unless you cancel at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period at the same price.
  • How to cancel: manage or cancel your subscription in iPhone or iPad Settings → [Your Name] → Subscriptions. You can also cancel through your Apple ID account page. Cancelling stops future charges and the subscription remains active until the end of the current billing period.
  • Free trials: Connect Alerts does not currently offer a free trial. If we introduce one in future, any unused portion of a free trial period will be forfeited when you purchase a subscription, where applicable.

NFC tags are sold as one-off purchases and are not part of the subscription. Web payments for one-off purchases are processed securely through Stripe; we never see or store your full card details.

11. Apple App Store licensed application terms

The following terms apply to your use of the Stimz Connect iOS application (the "Application") downloaded from the Apple App Store. The Application is licensed, not sold, to you for use only under the terms of this license. Flexi Fidgets Co. Ltd reserves all rights in and to the Application not expressly granted to you under this license.

Scope of licence. The licence granted to you is limited to a non-transferable licence to use the Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

Maintenance and support. Flexi Fidgets Co. Ltd is solely responsible for providing any maintenance and support for the Application. Apple has no obligation whatsoever to provide any maintenance and support services with respect to the Application.

Warranty. Flexi Fidgets Co. Ltd is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Application; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.

Product claims. Flexi Fidgets Co. Ltd, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and use of the Application, including product liability, failure to conform to applicable legal or regulatory requirements, and consumer protection claims.

Intellectual property. In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party's intellectual property rights, Flexi Fidgets Co. Ltd, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.

Third-party beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these terms, and that, upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.

Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

12. Intellectual property

The Stimz Connect name, logo, and all associated branding are the property of Flexi Fidgets Co. Ltd. You retain ownership of all content you upload to the service (photos, text, documents). By uploading content, you grant us a limited licence to store and display it as needed to operate the service.

13. Acceptable use

You may not use Stimz Connect to impersonate another person, create profiles for individuals without proper authority or consent, upload false or misleading medical information that could endanger others, attempt to access another user's account or data, interfere with the operation of the service, or use the service for any unlawful purpose. We reserve the right to suspend or terminate accounts that breach these terms.

14. Limitation of liability

Stimz Connect is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that alerts will always be delivered. To the fullest extent permitted by law, Stimz Connect shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded. Your statutory rights as a consumer under the UK Consumer Rights Act 2015 are not affected.

15. Termination and data export

You may close your account at any time from your dashboard. Before closing, you can request a data export by emailing hello@stimz.com. Upon closure, all profile data and associated records will be permanently deleted within 30 days. We may also suspend or terminate your access if you breach these terms. Any provisions that by their nature should survive termination (such as limitation of liability) will remain in effect.

16. Governing law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of England and Wales. Consumers resident in Scotland or Northern Ireland may also bring proceedings in their local courts.

17. Changes to these terms

We may revise these terms from time to time. We will provide at least 30 days' notice of material changes via email or in-app notification. Your continued use of the service after changes take effect constitutes acceptance of the revised terms.
